Asthma Lawsuit Settlements

Asthma settlements can be used to pay for medical expenses loss of wages, future expenses, as well as attorney's costs. A lack of care that causes occupational asthma can cause severe and debilitating effects for the affected worker.

The goal is to reduce emissions by 25 tons per year.

In other legal news from the county, the relatives of an inmate who died following an asthma attack in the county jail have settled a lawsuit against the county and its correctional health provider. The lawsuit raised questions about the jail's policy regarding asthma treatment.

The lawsuit claimed that PrimeCare medical staff ignored warning signs of breathing problems by requiring prisoners to go to the hospital for Albuterol mini-nebulizer treatment instead of giving them emergency inhalers to keep in their cells. The family, aided by attorneys Joseph E. Welsh and Philip D. Lauer of Lauer & Fulmer PC, asserted that her death could have been prevented in the event that she had received timely medical care.

The terms of the settlement were kept secret. In a different case, a jury awarded $55,000,000 the parents of an infant who suffered brain damage when she was born at St. Luke's University Hospital Allentown. The verdict was among the highest ever recorded in Pennsylvania.

3. Crozer Chester Medical Center

Located in UPLAND, CROZER CHESTER MEDICAL CENTER is a hospital that provides short-term acute care. Its rating is 3. The hospital has 665 doctors on its list of medical specialists. The hospital was founded in 1963 and is now under the control of Crozer Health System.

It is among the region's most well-known and advanced clinical facilities offering a wide range of surgical and medical services. It is also a teaching facility that teaches the next generation in healthcare and medicine through its undergraduate, residency and fellowship programs.

In January 2018 an individual was involuntarily admitted to the Crozer-Chester medical facility for psychiatric care in an emergency. He was not permitted to see his doctor or speak with his family before being transported to a hospital. The lawsuit claims that this violated the plaintiff's constitutional, legal and state law rights.

The lawsuit settlement will cover suspected air pollution violations in the hospital's medical-waste incinerator. The company was able to pay a fine and implement an asthma screening and treatment program for the Chester-Upland public schools. It must also educate its employees to recognize the signs of asthma attacks and respond appropriately. It will also hire an asthma nurse and care manager to oversee the two-year program.

The lawsuit was filed by the family of a deceased student from an asthma attack on campus in 2019. Adilene Carrasco was 13 when she enrolled in her class on a Oct. 31 walk to an athletic field for a Halloween "pumpkin chuckin contest" at Mesa View Middle School in Calimesa, east of Los Angeles. She wore an inhaler to reach the field, but she was suffering from breathing problems on the return journey. The teacher redirected her and a classmate back to their classrooms without determining if she was well enough to do so, the lawsuit said.

The Yucaipa-Calimesa Joint Unified School District has not admitted any wrongdoing but has agreed to adopt the California School Board Association's best practices for students with medical conditions. They will also collaborate with pulmonologists to provide the staff with instruction on how to manage asthma. It will also make modifications to its safety procedures for students suffering from medical conditions according to the family's lawyer, Robert Glassman.
